Today’s headline describing the Houston man badly burned in an apartment fire should be a wake up call to all tenants of apartments. Our prayers are with him for a complete and speedy recovery. Often, many folks in our community find themselves living in an apartment complex owned by uncaring and negligent landlords. If you have a landlord/tenant relationship, your landlord usually has a contractual obligation to make sure the apartments are properly maintained and equipped with the safety equipment required by law. Fire extinguishers, emergency exit plan, and smoke alarms are just a few of the standard requirement the landlord is obligated to provide. Failure of the landlord to meet these obligations could result in breach of contract by the fall under premises law.
