In the 2015 Texas Legislature, SB1628 was introduced to basically give more power to insurance companies to deny claims and avoid lawsuits from their insured customers after storms. The bill, if passed, “would require homeowners to provide advance notice and show proof of damages before filing a lawsuit alleging unfair treatment or insufficient payment of claims. It also would mandate that the filing take place within two years after the damage. Fortunately, the bill did not make it to the state House floor before a key deadline and could not be added on to any other bill. If passed, Texas homeowners could be fighting uphill battle when filing property damages claims after storms and floods. The bill, sponsored by TX state Senator Larry Taylor, who is an insurance agent himself, was a big flashpoint among Republicans and Democrats.
