When bars don’t have insurance

When a person gets drunk at a bar and then goes out and injures someone, should the bar that served the drunk driver that caused the accident be held liable? Absolutely, it is very common for establishments to provide beverages in excess of what is permitted by law. Also, in many cases, establishments are found liable for damages. But, unfortunately, many establishments either don’t have the financial means to compensate the injured parties, and that includes, not having insurance, or sufficient insurance to cover such damages. Currently it is not required for establishments to carry liability insurance as it relates directly to the sale of alcohol.

In this current session of the Texas legislature, there is an opportunity to change that and protect you and your family form drunk driver accident damages. There is a proposed bill by Rep Chris Turner from Tarrant County, to require establishments that derive the majority of their sales from alcohol for on-premise consumption, to carry minimum liability insurance to address damages to injured parties.

At this time, you or a loved one may have been the victim of a drunk driver accident. Or you may not. However, this bill could affect you in the future. You don’t know when you or a loved one may become the victim of a drunk driver accident, and may end up on the short end of this issue. We have seen so many cases where parties have been injured in drunk driving and other auto accidents where the injured party has no place to see compensation for their damages.

If you or a loved one has been in such a case, representative Turner’s office would love to hear from you to testify before committee so the bill can make it to the floor and eventually become law. If that is the case, please contact Rep Chris Turner’s office in Austin, TX by calling (512) 463-0574.
