The incident happened at a commercial construction site. Defendant was a roofing subcontractor at the worksite. Plaintiff was hired as a labor assistant by Defendant’s subcontractor. At the time of the incident, Defendant’s representative at the jobsite asked Plaintiff to drive the tractor-trailer that was used to collect the trash from the work Defendant had done. Plaintiff had been told to cover the trailer with a makeshift tarp to keep debris from falling out of the trailer during transport. As Plaintiff began putting the tarp over the trailer with another employee he fell due to the hazardous working condition and lack of proper supervision. He suffered severe injuries.
